Welcome to the Erphex ERP Software platform. These Terms and Conditions (“Terms”) govern your access to and use of our software, services, and website (“the Service”). By using the Erphex ERP platform, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Definitions

  • “Company,” “we,” “us,” or “our” refers to Erphex, a product of Pluxmedia Network – a registered business in Nigeria.
  • “User,” “you,” or “your” refers to any individual or entity accessing or using the Service.
  • “Service” refers to the ERP software platform, associated applications, and support services provided by the Company.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our Service. By registering an account, you represent that you meet these requirements.

3. Account Registration and Access

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to provide accurate, current, and complete information during registration.
  • You are liable for all activities that occur under your account.

4. License and Use

We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business operations, subject to compliance with these Terms.

You agree not to:

  • Reverse engineer, decompile, or modify any part of the software
  • Use the Service for unlawful or harmful activities
  • Resell or sublicense the platform without our prior written consent

5. Payment and Subscription

  • Subscription fees are billed monthly or annually, based on your chosen plan.
  • All fees are payable in Nigerian Naira (₦) and are non-refundable, except as expressly stated.
  • We reserve the right to change pricing, with notice provided 30 days in advance.
  • Failure to pay may result in suspension or termination of your account.

6. Data Protection and Privacy

  • We take your data privacy seriously. All data collected is handled in accordance with Nigeria’s Data Protection Regulation (NDPR).

    • We do not sell or share your data with third parties without your consent.
    • You are responsible for securing your data and for any data uploaded to the platform.

7. Intellectual Property

  • All content, software, logos, trademarks, and related intellectual property remain the exclusive property of Pluxmedia Network.

    You may not use, copy, or distribute our content without prior written permission.

8. Service Availability and Support

    • We strive for 99.9% uptime, but do not guarantee uninterrupted access.
    • Scheduled maintenance and updates may temporarily affect availability.
    • Technical support is available during Nigerian business hours via phone, email, or live chat.

9. Termination

We reserve the right to suspend or terminate your access to the Service if:

  • You breach these Terms
  • You fail to pay your subscription fees
  • You engage in any activity that may harm our software, reputation, or users

Upon termination, your access will be revoked, and your data may be deleted after 30 days.

10. Limitation of Liability

To the maximum extent permitted by Nigerian law, we are not liable for:

  • Any indirect, incidental, or consequential damages
  • Loss of data, revenue, or business opportunities
  • Any unauthorized access or use of your account or data

11. Indemnity

You agree to indemnify and hold harmless Pluxmedia Network, its directors, employees, and affiliates from any claims, losses, or damages arising from your use of the Service or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms shall be resolved in Nigerian courts.
